These terms and conditions, which we may update periodically, are applicable to our website (“Australianhunters.com.au”), emails, text messages, and social media accounts. By using our services, you confirm that you have read, understood, and agree to be bound by the terms and conditions outlined below (including the Privacy Policy).

I. Our Services

The Australian Hunters Club provides a subscription membership service that grants users access to a range of benefits available via our website, social media, events, and partner websites.

These services are accessed through the purchase of a membership subscription and include (but are not limited to) physical and digital club meetings, club events, professional hunting experience giveaways, hunting product giveaways, hunting product discounts, hunting resources, membership directory, harvest/trophy reports, and digital content.

Membership subscriptions are divided into three tiers: Basic, Premium, and Platinum, with each tier offering the option for monthly or annual automated billing.

By registering for one of these subscriptions, you agree to be automatically charged the membership fee as per the billing schedule described, through your nominated credit card.

II. Privacy Policy

Your privacy is of utmost importance to us. Please review our Privacy Policy for information regarding the collection and use of your personal information by the Australian Hunters Club.

III. Disclaimer

Our website, all content, and services provided on our website are offered on an “as is” and “as available” basis. Australian Hunters Club expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy and security.

Australian Hunters Club makes no warranty, and expressly disclaims any obligation, that:

  • our website will meet your requirements or will be available on an uninterrupted, timely, secure, or error-free basis.
  • the content will be up-to-date, complete, comprehensive, accurate, or applicable to your circumstances.
  • the results that may be obtained from the use of our website will be accurate or reliable.
  • the quality of any products, services, information, or other material obtained by you through the site will meet your expectations.

Subject to the limitations outlined in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid, or incurred by you due to an attributable shortcoming of our obligations in respect to our services.

However, and to the extent permitted by law, we (together with our officers, directors, employees, representatives, affiliates, and providers) will not be responsible or liable for:

  • any damages to or viruses that may infect your computer equipment or other property as a result of your access to our website or your downloading of any content from our website.
  • any punitive, special, indirect, or consequential loss or damages, including but not limited to loss of production, profit, revenue, contract, or goodwill.
  • any inaccuracies relating to the information (including rates, availability, and ratings) of hunting tours available on our website.
  • the services rendered or the products offered by The Australian Hunters Club or other business partners.
  • any damages, losses, or costs suffered, incurred, or paid by you, pursuant to, arising out of, or in connection with the use, inability to use, or delay of our website.
  • any personal injury, death, property damage, or other damages, losses, or costs suffered, incurred, or paid by you, whether due to acts, errors, breaches, negligence, misconduct, omissions, non-performance, misrepresentations, tort, or strict liability by or attributable to use of our services.

IV. Membership

By subscribing to the Australian Hunters Club, you agree to abide by these Terms & Conditions and confirm that you meet all eligibility requirements.

Definitions

a) Club: The term “club” refers to the Australian Hunters Club, operated by AMELPA PTY LTD, a private company, which provides hunting-related services, resources, and community engagement opportunities to its members.

b) Membership: The term “membership” refers to the status granted to individuals who subscribe to the Australian Hunters Club and agree to these Terms & Conditions. Membership includes access to club services, events, discounts, and resources as outlined in these Terms & Conditions.

Eligibility Requirements

a) Age Requirement: You must be at least 18 years old to subscribe to the Australian Hunters Club.

b) Compliance with Laws: You agree to comply with all applicable laws and regulations regarding your use of the Australian Hunters Club services.

Account Responsibility

a) Account Security: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account or password.

b) Account Information: You agree to provide accurate and complete information when creating your account and to promptly update your account information if it changes.

Subscription Terms

a) Payment: By subscribing to the Australian Hunters Club, you authorize us to charge your chosen payment method for the subscription fee and any other charges you may incur in connection with your use of the service.

b) Automatic Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel it prior to the renewal date. You agree that we may automatically renew your subscription and charge your payment method for the renewal term.

c) Cancellation: You may cancel your subscription at any time by following the instructions on the Website. Cancellations must be made prior to the renewal date to avoid being charged for the next subscription period.

Termination

We reserve the right to terminate or suspend your subscription and access to the Australian Hunters Club services at any time without prior notice or liability for any reason, including, but not limited to, breach of these Terms & Conditions or fraudulent or illegal activity.

Modifications

We reserve the right to modify, suspend, or discontinue the Australian Hunters Club services or any part of them at any time without notice or liability to you.

V. Giveaways

Eligibility: Members with an ‘Active’ Premium or Platinum membership plan are eligible to win product giveaways and must be of legal age in their state or country of residence prior to the date of entry. An ‘Active’ membership plan is one that is up to date in all payments.

Members with an ‘Active’ Platinum membership plan are eligible to win hunting experaince giveaways and must be of legal age in their state or country of residence prior to the date of entry. An ‘Active’ membership plan is one that is up to date in all payments.

Members with membership plans labeled as ‘pending payment’, ‘on hold’, ‘paused’, or ‘failed’ due to failed scheduled payments will not be included giveaway draws until such a time as the plan has become ‘active’ again. To be entered into the draw, a member must have an active membership plan with all fees paid and up to and including the date the giveaway winner is drawn.

To be eligible for any hunting experience giveaways that involve firearm use, members must hold a current and active Australian firearms license.

Sponsor: The Sponsor is the individual, business, organization or entity contributing and offering a product or services as part of a giveaway. Services may include, but not limited to products, licenses, subscriptions, discount codes, discount cards, memberships, organized activities, guided hunts, self guided hunts, access to hunting properties, accommodation, food products, education, courses and workshops.

Prize(s) and winner selection method: Australian Hunters Club will award prizes to eligible individuals. The giveaway announcement post accessible via the Australia Hunters Club website will specify the prize(s), prize specifications, any special conditions, and end dates. Winners will be selected from eligible entries received and notified via email. The winner announcement may also be shared via Australian Hunters Club’s website and affiliated platforms.

Australian Hunters Club reserves the right to publicly broadcast and live stream the selection of giveaway winners. By entering, applicants agree to the public sharing of their name.

Only one entry per member is allowed.

Prize fulfillment: Prize fulfillment and delivery of physical goods will be managed by either the Sponsor or Australian Hunters Club. Each winner is responsible for any taxes and expenses incurred.

Prize fulfillment, delivery of the hunting activities, workshops, training, education, experiences or other services fulfilled in person will be managed by the Sponsor associated with this activity.

Each prize is awarded “as is” and without warranty. Prizes cannot be transferred, assigned, or redeemed for cash. The Sponsor or Australian Hunters Club will not substitute a prize with another prize.

Entry process: Entry into the monthly product giveaways is automatic for all eligible Platinum and Premium members. 

Entry into the monthly hunting experience giveaway requires eligible Platinum members to fill out the annual hunting experience giveaway form as it relates to the year in which these giveaways are being conducted. This giveaway form can be found on the Australian Hunters Club website, on each giveaway post and emailed to Platinum members upon their registration. 

Giveaway entry restrictions: Giveaways are limited to one entry per month. Members who submit multiple entries into the hunting experience giveaways will be disqualified.

Disclosure in connection with entry: If you choose to promote your entry, you should disclose your connection to the Australian Hunters Club.

Additional terms: The Sponsor, together with Australian Hunters Club, reserves the right to modify or cancel a giveaway at any time. The Sponsor, Australian Hunters Club, and their affiliates are not responsible for lost or incomplete member information, entry errors, or damage to any computer or device. Disqualification may occur for individuals found to be tampering with giveaways or violating these Terms & Conditions.

No greater than the number of prizes stated in a giveaway announcement post will be awarded. If errors occur in selecting a winner, or if more prizes are claimed than specified, the Sponsor or Australian Hunters Club may award prizes by random drawing from eligible claimants.

In the event that a prize is not available, a substitute will be provided in it’s place at the discretion of the Australian Hunters Club.

Governing Law: Each giveaway is governed by the laws of Victoria, Australia. By entering a giveaway, you agree that the Released Parties will have no liability for any losses or damages incurred. Sponsor decisions related to giveaways and prize distribution are final.

Liability:

Participants expressly acknowledge and agree that Australian Hunters Club assumes no liability for any damages, injuries, or losses arising from prizes, services, or activities offered or delivered by Sponsors. This includes, but is not limited to, damages resulting from defective products, accidents during activities, or any other unforeseen circumstances.

Participants understand and accept that Australian Hunters Club acts solely as a facilitator or intermediary in providing access to prizes, services, or activities offered by Sponsors. Australian Hunters Club does not endorse, warrant, or guarantee the quality, safety, or suitability of any prize, service, or activity provided by Sponsors.

Participants further acknowledge that it is the sole responsibility of the Sponsor to provide and ensure the safety of participants in activities such as guided hunts. Australian Hunters Club does not have control over the provision or execution of these services and shall not be held liable for any incidents or accidents that may occur during such activities.

By participating in giveaways or activities facilitated by Australian Hunters Club, participants waive any claims or demands against Australian Hunters Club, its officers, directors, employees, agents, and affiliates, arising from or in connection with the prizes, services, or activities offered by Sponsors.

Participants agree to indemnify and hold harmless Australian Hunters Club, its officers, directors, employees, agents, and affiliates from any claims, damages, or liabilities arising from their participation in giveaways or activities, including but not limited to, claims for personal injury, property damage, or financial loss.

VI. Subscription and Payment Terms

Payment

Scheduled membership subscription payments by your nominated credit card are automatically processed via Stripe, based on the subscription period you chose when signing up. To learn more about Stripe and its security protocols and the protection of your data, please visit the Stripe website.

All prices and dollar amounts on this Website are in Australian dollars.

We reserve the right to stop accepting credit cards from one or more issuers.

By submitting a credit card number to Stripe via Australian Hunters Club, you are representing and warranting that the credit card information you provide is valid, authentic, current, and one that you are authorized to use.

You agree that in the event the credit card information you have provided becomes invalid, out of date, or that you are no longer authorized to use the card, you will immediately provide another credit card number that is valid, authentic, and current, and which you are authorized to use. Credit card information can be changed via the accounts page.

Some electronic transactions may require extended processing in addition to credit card authorization. This may affect your access to member content or restricted members areas.

Failed Payments

If a charge against a credit card you provide is not authorized or accepted, or is subsequently refused or rejected, we reserve the right to cancel your order without notice or liability.

When a scheduled credit card payment fails, the Australian Hunters Club website commences a payment retry process, which can take up to 8 days to complete fully. During this process, the user’s membership is temporarily suspended, along with their access to membership content, and they will not be eligible for giveaways. During this period, the membership plan will be marked as either ‘pending‘ or ‘paused‘ and subsequent subscription as ‘on hold‘ in the user’s account page.

To regain access to the membership, the customer will need to log in to the website and reactivate their membership subscription via the subscription page in the accounts section by adding a valid credit card. Failure to do so in a timely fashion will result in the membership being canceled. Instructions will be sent to the user outlining this process and dates required for payment.

Recurring Billing

Membership products consist of recurring period charges as agreed to by you. By choosing to purchase a membership subscription plan, you acknowledge that such Services have a recurring payment feature, and you accept responsibility for all recurring charges prior to cancellation. All recurring payments are fully earned upon payment. You can learn more about your subscription billing frequency via the subscriptions information accessed via your account page.

Unless upgraded or downgraded, your subscription will be automatically extended for successive periods at the then-current subscription rate.

Switching Memberships/Subscriptions

Users with active memberships can upgrade and downgrade subscription levels whenever they want.

To change a subscription, the user must go to their ‘Accounts page’ and click on the ‘Subscriptions‘ tab. This will take them to their membership subscription page where they can click the ‘Upgrade or Downgrade Membership’ button in the ‘Subscription totals’ area.

Now the user can select a new membership subscription from the list, including monthly and annual variants of the basic, premium, and platinum memberships.

Note: Switches are prorated, and additional payment may be required to complete the process.

Credit Card

By subscribing to our services on www.australianhunters.com.au, you agree to provide and maintain a valid credit card. This credit card will be used for the recurring billing of your subscription.

All credit card transactions are processed securely through Stripe, which employs industry-standard encryption and security measures to protect your sensitive information. Your credit card details are encrypted and securely transmitted to Stripe for processing, ensuring the highest level of data security.

Stripe is fully PCI DSS compliant, meeting the stringent security standards set by the Payment Card Industry Data Security Standard. This compliance ensures that your credit card information is handled with the utmost care and in accordance with industry regulations.

By leveraging Stripe’s secure infrastructure, we aim to provide you with a safe and trustworthy environment for managing your subscription payments.

It is your responsibility to ensure that your credit card information remains current and valid. In case of any changes, such as a new card issuance or expiration date, please update your information promptly through your account settings under the Payment Methods tab.

VII. Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or any third-party for any modification, price change, suspension, or discontinuance of the Service.

VIII. Products or Services

Certain products or services may be available exclusively online through the website, with limited quantities and subject to return or exchange only according to our Return Policy. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction, and may exercise this right on a case-by-case basis. Descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We also reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, nor do we guarantee that any errors in the Service will be corrected.

IX. Discounts

Discounts are provided to members as part of their membership and subscription. Australian Hunters Club reserves the right to suspend or terminate membership without notice in the event of unauthorized sharing of course or product discount codes, links, promotions, or information.

Discounts are subject to change.

Member discounts on hunts advertised on Hunting Trips Australia (huntingtrips.com.au) are displayed as a ‘member price’ on the listing and listing preview. The decision to list a member discount on a given hunt is the responsibility of the individual outfitter/guide and is subject to change. Hunting Trips Australia and Australian Hunters Club make no guarantee on the number or value of listed hunt discounts available to members. For more information about the pricing of a specific hunt or course listed on the website, please contact the outfitter via the listing’s contact form.

While we strive to provide accurate and up-to-date information on discounts, we do not guarantee the accuracy, completeness, or reliability of discount offers displayed on the website. Australian Hunters Club shall not be held responsible for any discrepancies in discount pricing or availability. Members are encouraged to verify discount details directly with the respective product or service provider before making any bookings or purchases.

X. Member Harvest and Trophy Records

Members have the opportunity to submit harvest and trophy records, which may be shared through the Site with other Members. By creating and submitting a harvest and trophy record, you agree to certain terms, including the visibility of the information to all Australian Hunters Club members and limitations of liability for Australian Hunters Club. You agree to upload content and create records only for animals that you have hunted and to respect the copyright of others. You will not share any harvest or trophy records with anyone who is not a member of the Australian Hunters Club, nor post this content online. You certify that any information or content you include within a harvest and trophy record is true and accurate, and you will moderate your content to exclude any defamatory, rude, aggressive, racist, sexist, or illegal material. De-identified harvest and trophy records data may be provided to government agencies or their representatives. By creating the record, you give The Australian Hunters Club and its representatives permission to share the information and content within that record with other members and the general public in advertising, marketing, or social material. The Australian Hunters Club reserves the right to remove and delete any harvest or trophy record without warning, at any time.

XI. Hosted Events and Hosted Hunting Activities

Introduction:

Individuals have the opportunity to organize and advertise hunting trips or events through the ‘Host A Hunt’ or ‘Host An Event’ feature on the Australian Hunters Club website. By utilizing this service, individuals understand and agree to the following terms and conditions:

Organizational Responsibility:

All ‘Host A Hunt’ and ‘Host An Event’ activities are solely organized, facilitated, and managed by the individual who creates them. These activities are not official endeavors of Australian Hunters Club or Hunting Trips Australia. Therefore, the responsibility for planning, execution, and safety lies entirely with the hosting individual.

Acknowledgment of Listing:

By creating a ‘Host A Hunt’ or ‘Host An Event’ listing, individuals acknowledge that their activity will be listed on both the Australian Hunters Club website (australianhunters.com.au) and the Hunting Trips Australia website (huntingtrips.com.au) for members to view and express interest in attending.

Acknowledgment of Risk:

Participants acknowledge the inherent risks, hazards, and dangers associated with hunting, which may include but are not limited to:

  • Handling firearms, knives and related dangerous equipment.
  • Risk of injury from accidental or intentional discharge of weapons.
  • Risk of injury from knife,
  • Hazards of rugged terrain and natural elements.
  • Encounters with poisonous plants, venomous creatures, and inclement weather.

Safety Measures:

Individuals hosting hunting activities agree to:

  • Conduct themselves in a responsible manner.
  • Adhere to all federal and state hunting laws and regulations.
  • Refrain from alcohol or substance consumption during the hunt.
  • Ensure a blood alcohol level of 0.00% throughout the activity.
  • Possess valid firearm and game licenses for the respective state.

Participant Interaction and Conduct:

Participant Communication: Participants who express interest in attending hosted hunting activities are encouraged to communicate directly with the host. While communication through the designated channels on the Australian Hunters Club website is preferred, hosts may also communicate with participants outside of the platform if necessary.

Host Responsibility: The host is responsible for managing all communications with participants, whether conducted through the Australian Hunters Club website or outside of the platform. Hosts should exercise caution and discretion when interacting with participants and ensure that all communication is conducted in a professional and respectful manner.

Safety Reporting and Improvement:

Safety Reporting: If you encounter any safety concerns, incidents, or emergencies while participating in a hosted hunting activity or event, we encourage you to report them promptly. Your reports help us identify areas for improvement and take proactive measures to enhance safety awareness and practices. Please use the contact page at www.australianhunters.com.au/contact to report any safety-related issues.

Feedback and Growth: We value your feedback and insights as they contribute to the continuous improvement of our members’ hunting and event experiences. Whether you have suggestions for enhancing safety practices, improving the overall experience, or addressing specific concerns related to hunting activities or events, we welcome your input. Your feedback helps us create a supportive environment where members can learn and grow as responsible hunters. Emergency Preparedness:

Emergency Procedures: Hosts are required to develop and communicate emergency procedures to participants prior to the start of the activity. Emergency procedures should include protocols for responding to accidents, injuries, medical emergencies, and adverse weather conditions. Hosts should ensure that all participants are aware of the emergency procedures and know how to respond appropriately in case of an emergency.

First Aid Kit: Hosts are encouraged to carry a well-equipped first aid kit during the activity and be prepared to provide basic first aid as needed. First aid kits should include essential supplies such as bandages, antiseptic wipes, pain relievers, and emergency contact information.

Communication Plan: Hosts should establish a communication plan to maintain contact with participants and emergency services if necessary. This may include providing participants with emergency contact numbers, establishing designated meeting points, and ensuring access to communication devices such as mobile phones or two-way radios.

Conclusion: By hosting a hunt or event and participating in hosted hunting activities, individuals agree to abide by these terms and accept all associated responsibilities and liabilities. Australian Hunters Club is committed to supporting members in their hunting endeavors and promoting a culture of safety, responsibility, and camaraderie within the hunting community. Thank you for your dedication to safety and growth within the Australian Hunters Club community.

XII. Membership Directory and Member Profiles

Members of the Australian Hunters Club at any tier (except those in a trial period) have the opportunity to create a member profile. These profiles appear on the club’s website within the members directory and can be filtered and viewed by other members who have active profiles. This is an optional service available to members.

Profile Usage and Privacy

To prevent misuse of this service, only members with profiles can use the members directory and view other members’ profiles. Each member can only have one profile at any given time. Profiles can be edited or deleted by the member at any point via the members account page. However, please note that deleting a profile may result in loss of access to the members directory.

Every profile includes a contact form that allows other members to send emails to each other. The Australian Hunters Club website facilitates this process by sending the email on behalf of the member who submitted the form. Through this process, the club ensures that members’ email addresses remain private. It is then up to the recipient member to decide whether or not they wish to respond to the email. Form submission data through profiles is saved for archival, reporting, and complaint management purposes.

Content Guidelines and Misuse Policy

We value our members’ privacy, and as such, we hide all personal, private, and contact information on member profiles, including last name, full address, and email address.

Members must only upload images or input written content to their profiles that they own or have the license for. Uploading copyrighted material may result in the deletion of the member’s profile and termination of their membership.

When creating or editing a profile, members must be truthful and refrain from misrepresenting themselves. Uploading misleading material may result in the deletion of the profile and termination of membership.

Misuse Policy

Representatives of AMELPA PTY LTD reserve the right to delete a member’s profile or terminate their membership if they misuse this service by creating user-generated content that is abusive, pornographic, sexist, sexual, racist, disrespectful, distasteful, involves public slander, violence, or any other content deemed inappropriate by the representatives. Abusive content is not limited to written or visual content.

Furthermore, the representatives of AMELPA PTY LTD reserve the right to restrict access to members, delete members’ content and profiles, or terminate a member’s membership if they engage in spamming or abuse of the contact forms on either a single member’s profile or multiple members’ profiles. These forms are intended to facilitate initial introductions and connections among members and are not designed for ongoing conversations, self-promotion, or highlighting misconduct.

XIII. Genuine Reason

Through both the Premium and Platinum membership tiers, The Australian Hunters Club offers NSW members the option to use their membership with the club to apply for an R-Licence, thus gaining access to the “Recreational Hunting / Vermin Control” category, a genuine reason for owning a firearm. This status is utilized when filling out a firearm application.

  • Premium and Platinum members with annual memberships gain immediate access to this option upon signing up.
  • Premium and Platinum members with monthly memberships gain access 92 days after signing up.
  • Members must report the expiry of their R-Licence, acquired through club membership, immediately to The Australian Hunters Club via the contact page. Failure to do so may result in membership termination.
  • If membership is canceled due to failed payment, member request, termination, or downgrading to the basic tier, R-Licence application access is immediately revoked. The club reports this status change to the NSW firearm registry promptly.
  • Members intending to cancel their membership while using the Australian Hunters Club as their genuine reason must obtain genuine reason status through another club before cancellation. Failure to do so may result in loss of firearm license, forfeiture of firearms, and potential legal repercussions. 

XIV. Public Liability Insurance

Members with an active R-Licence acquired through The Australian Hunters Club membership are covered with public liability insurance by NSW DPI Hunting when hunting under standard recreational license conditions in NSW.

  • The insurance covers bodily injury and/or property damage to third parties up to the value of $25 million.
  • Coverage includes hunting on private land for species listed in the Game and Feral Animal Control Act 2002 and on public land under the terms of an NSW Restricted Game Hunting Licence (R-Licence) with written permission.
  • The policy excludes commercial hunting or hunting for reward (guided hunting). However, if commercial or guide license holders hunt recreationally without compensation, they are insured. It is imperative for these license holders to maintain records distinguishing between paid and private hunting activity for insurance purposes.
  • Coverage is limited to NSW; it does not extend beyond the state. Members can find more information about insurance available to R-Licence holders via the NSW DPI Hunting website. 

XV. Trial Membership

The Australian Hunters Club offers a trial membership designed to provide a preview of club benefits before committing to a paid membership.

  • Trail membership lasts for 90 days. On the 91st day, it automatically upgrades to Basic Membership with an annual subscription plan, triggering automated billing.
  • During the 90-day period, members cannot create harvest/trophy reports, view such reports, create a membership profile, or access the member directory. These features become available automatically after the trial period.
  • Members can request cancellation of their trial membership at any point during the 90 days to avoid charges. Cancellations after the 90 days follow our refund policy terms. 

XVI. Product Discounts

Active club members can purchase exclusive member products via the club’s online store. Discounts on eligible products vary based on the user’s membership tier at the time of purchase:

  • Basic membership: 5% off eligible products
  • Premium membership: 10% off eligible products
  • Platinum membership: 15% off eligible products

Discounts do not apply to shipping fees or digital gift cards.

XVII. Refund Policy

The Australian Hunters Club offers refunds and replacements in compliance with the Australian Consumer Law and the terms outlined in this Refund Policy.

Refund Eligibility & Change of Mind

Per the Australian Consumer Law, we do not issue refunds for products, gift cards, or memberships if the purchaser changes their mind.

To qualify for a refund, the product, service, subscription, or membership must be faulty, not of acceptable quality, unfit for its intended purpose, or not match the sample or our description.

Membership Refunds

  • Annual Memberships: Annual billing cycle members (excluding trial memberships) may request a refund (minus payment gateway charges) within 7 days of their most recent annual payment. After this period, membership payments become non-refundable per applicable laws. No refunds or credits are available for partial membership periods.
  • Monthly Memberships: Memberships with a monthly billing cycle are not eligible for refunds.
  • Trial Membership Upgrades: If a trial membership upgrades to a full membership with an annual billing plan, 91 days after registration, members can request a partial refund within 7 days of the upgrade. The refund is calculated considering 3 months of benefits enjoyed without charges during the trial period. Alternatively, members can choose to replace the upgraded membership with a digital membership gift card of equal value or receive a free upgrade to another plan.

Digital Membership Gift Card Refunds

We reserve the right to decline refunds for digital membership gift cards.

Physical Goods Refunds

  • We accept returns of physical goods and provide refunds or repairs if:
    • The item is faulty, not of acceptable quality, or unfit for its intended purpose.
    • The product does not match the sample or our description.
    • A receipt or adequate proof of purchase is presented.
  • To receive a refund, you must return the item at your expense. We cover the costs of sending a new product if the refund is eligible under Australian Consumer Law.
  • We may send the product to the manufacturer’s repair agent to assess the issue. We reserve the right not to offer an exchange voucher, refund, or repair if the item fault results from misuse or neglect.
  • Repaired goods may be replaced by refurbished goods of the same type. Refurbished parts may be used for repairs.
 

XVIII. Accuracy of Billing and Account Information

We reserve the right to refuse any order placed with us. We may limit or cancel quantities purchased per person, household, or order at our discretion. This includes orders placed under the same customer account, credit card, or billing and shipping address. If we make changes to or cancel an order, we will attempt to notify you via the contact information provided.

You agree to provide current, complete, and accurate purchase and account information for all transactions. It is your responsibility to update your account and other information promptly to ensure the completion of transactions and timely communication.

XIV. Intellectual Property Rights

Unless stated otherwise, Australian Hunters Club owns the australianhunters.com.au website, including all text, images, software, trademarks, or other materials contained within. You may not copy or transmit any part or content of our website, except for personal, non-commercial use on your computer.

By providing us with feedback, including but not limited to hunters’ reviews, suggestions, ideas, ratings, or similar content, you agree that:

  • We own the feedback and any associated intellectual property rights.
  • We can use and share your feedback without your consent.
  • At our request and expense, you will assist us in acquiring, perfecting, and maintaining intellectual property rights for the feedback. We reserve the right to review, edit, or delete any feedback at any time.

Certain content, products, and services available through our Service may include materials from third parties. Links to third-party websites on our site may direct you to sites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. Except as provided in this warranty and to the extent permitted by law, Hunting Trips Australia and Australian Hunters Club shall not be liable for any loss, damage, or injury resulting from any breach of warranty or condition, or under any other legal theory. This includes direct, indirect, special, incidental, or consequential damages, regardless of cause. Some states or countries may not allow the exclusion or limitation of incidental or consequential damages, in which case this provision will be given the maximum effect permitted by law.

XVII. Miscellaneous

We reserve the right to modify, suspend, or terminate our website or any portion thereof, including services or products, at any time for any reason, with or without notice. These terms and conditions and the provision of our services are governed by and construed in accordance with the law. Any dispute shall be submitted exclusively to the competent courts in Victoria, Australia.

If any provision of these terms and conditions is invalid, unenforceable, or non-binding, you shall remain bound by all other provisions. In such event, the invalid provision shall be enforced to the fullest extent permitted by law, and you agree to accept a similar effect as the invalid provision.

XVIII. Governing Law

These Terms and Conditions and any agreements for services are governed by and construed in accordance with the laws of Victoria, Australia.

XIX. Changes to Terms and Conditions

We reserve the right to update, change, or replace any part of these Terms and Conditions. Your continued use of our website or services following any changes constitutes acceptance of those changes.
